STATEMENT ABOUT THE DECISION OF THE SUPREME COURT TO THE AMNESTY REVOCATION OF SENATOR TRILLANES

I am in mixed emotions after the SC denied Senator Antonio Trillanes IV's petition for an injunction against the withdrawal of his amnesty over 2 failed uprisings during the Arroyo administration.


Supreme Court’s Acting Public Information Officer and Spokesperson, Atty. Ma. Victoria Gleoresty Guerra said that the Makati City court that heard Trillanes' case should decide on the legality of President Rodrigo Duterte's proclamation that voided his amnesty. The high court then ordered the Office of the Solicitor General (OSG) to comment on Trillanes plea within 10 days for further deliberations.


The denial of the petition is anchored on the President's acknowledgment that no arrest will be made without warrant issued by the trial courts. Trillanes "will not be apprehended, detained or taken into custody" without the warrrants from the regional trial courts.

According to SC’s recolution,"there is no extreme and urgent necessity for the Court to issue an injunctive relief considering that the respondents have acknowledged Senator Trillanes' right to due process."


A part of the High Court’s decision, it suggests that Senator Trillanes is still a free and innocent man - since that he cannot be arrested by any uniformed personnel without any warrant from the trial court. So the legislator can go back to his daily routine being free from warrantless arrest.


But on the other hand, the decision of SC means that it nullified its power to decide on his case, as it mandates the Makati RTC and/or the Court of Appeals to act on the Justice Department’s directive to issue a warrant of arrest and hold departure order against Senator Trillanes. So the fight is not yet done.


I am hoping that this case shall be resolved immediately and apparently, revoking the proclamation of the President and not the amnesty granted lawfully and constitutionally to Senator Sonny Trillanes.
